Personal Data Protection Notice

OeruVersion 4[DRAFT · 21 September 2026 · For discussion purposes only]

Published in English.

Contents

This Notice explains what Oeru does with personal data. Oeru is the applied AI platform at www.oeru.com, operated by Fortifi Sdn. Bhd. (Company Registration No. 202501006593 (1608007-V)). It is issued under Section 7 of the Personal Data Protection Act 2010 (“the Act”).

Words defined in our Terms of Use have the same meaning here.

This Notice is issued in the national language and in the English language. If the two versions are inconsistent, the English version prevails. You can exercise every choice described here in either language.

1At a glance

This summary is not a substitute for the rest of the Notice, but it is the short version:

  1. (a)We do not train AI models on your material. Our own models are not trained on it, and we switch on the no-training setting wherever a model provider offers one.
  2. (b)We do not sell your data, and we do not pass it to anyone for their own marketing.
  3. (c)Every agent on the platform is AI. Meera is not a person. None of them is.
  4. (d)A person always decides. Nothing that affects you legally is decided by the system alone, and every Output comes to you to review.
  5. (e)Data about your own customers and staff stays yours. You decide what happens to it; we only act on your instructions. Clause 3 explains the split.
  6. (f)Your uploads are stored in Malaysia. Some of the services we use to process them are not. Clause 9 lists where.

2Who we are and how to reach us

2.1

Oeru is organised into Departments, each run by an AI agent. As at the date of this Notice the Departments are Marketing, Customer Service and Sales.

2.2

3When we are the controller and when we are your processor

3.1

This matters, because it decides who is responsible for what.

We are the data controller
of the data you give us about yourself and your business: your registration details, your sign-in and account records, your billing and Credit records, your messages to us, and our logs of how you use the platform. We decide what happens to it, and this Notice governs it.
We are your data processor
of the data about other people that you upload so we can work on it: your customers, contacts, suppliers and staff. You decide what happens to it. We act only on your instructions, which you give by using the Services.
3.2

Where we are your processor:

  1. (a)you are the data controller, and a controller’s duties under the Act are yours;
  2. (b)telling those individuals about this processing is your job, not ours. We have no relationship with your customers or staff and cannot notify them;
  3. (c)you are responsible for the consents you needed to obtain, and for answering a request one of them makes to you; and
  4. (d)Schedule 1 to our Terms of Use sets out the contract between us for that processing, and it prevails over this Notice in respect of it.
3.3

Clause 10 explains the practical arrangements, including what we do if one of those individuals comes to us directly.

4What we collect

Registration
Your name, business type, business website, email address and contact number.
Business details
Your business name, address, registration details, opening hours and outlet particulars, as you give them.
Account and sign-in
One-time sign-in codes and records of access to your Account.
Customer Material
Your logo, product photographs, business records and anything else you upload. This may include the likeness of an identifiable person.
Customer Data
Data about other people inside what you upload, typically your own customers, contacts, suppliers and staff, and their names, contact details and dealings with you. We hold this as your processor under Clause 3.
Prompts and Outputs
What you tell Meera, the Instruction Brief prepared from it, and the Outputs generated for you.
Billing
Your Plan, Credit balance and movements, and your payment records. We never receive or store your full card details.
Messages
Your emails to us, your messages on our business line, your approvals, and your enquiries and complaints.
Technical
Logs of your use of the platform, including a hashed form of your internet protocol address, the pages you open and when. We use these for security and to keep the service working.
Boost
Where you use Boost, the Output published on our social media accounts and the public engagement the platform records against it.
4.1

We do not ask for sensitive personal data and the platform is not built for it. Clause 11 applies if it reaches us anyway.

4.2

We collect no personal data from a member of the public who uses a voucher published through Boost. A voucher is redeemed with the merchant at the merchant’s premises. There is no registration, no sign-up and no data capture by us at the point of redemption. If the merchant takes a name, a telephone number or any other detail at that point, the merchant collects it for the merchant’s own purposes, as data controller, and we neither receive it nor process it.

5Where it comes from

From you, when you register, upload, describe what you need to Meera, or write to us. Automatically, from the logs described above. From your own records, where you upload data about other people. From our payment processor, when a payment succeeds or fails. From a social media platform, where someone engages with a campaign you have Boosted.

6What we use it for

Running your Account
Opening and administering it, signing you in, tracking Credits, and taking your instructions through Meera.
Marketing Department
Generating posters and short videos from your material, and content built around your product with your brand on it.
Customer Service Department
Onboarding your new customers, classifying the enquiries you receive, drafting replies from material you have approved, and summarising for escalation.
Sales Department
Organising your leads, drafting proposals, and planning follow-up.
Boost
Publishing an Output you have approved, and reporting engagement back to you.
Billing
Taking payment, administering Plans and Credits, and keeping accounting and tax records.
Support
Answering you, obtaining your approvals, giving you notices and handling complaints.
Security and abuse
Keeping the platform secure, detecting and preventing fraud and misuse, and investigating it.
Improving the service
Understanding how the platform is used, in aggregated or de-identified form wherever we can. Clause 7 explains the limits.
Law and regulators
Complying with the law, answering a regulator, a court or a law enforcement agency, and establishing or defending legal claims.
6.1

We rely on your consent, and on Section 6(2) of the Act where it permits processing without consent, in particular where processing is necessary to perform our contract with you or to comply with a legal obligation.

6.2

We do not sell personal data, and we do not disclose it to anyone for their own marketing.

7How AI uses your data

7.1

AI is how the service works, so this Clause is worth reading.

7.2

What happens. You describe what you need to Meera. Meera prepares an Instruction Brief and routes it to a Department. The Department’s agent generates the Output from your material. To do that, the relevant material is sent to third-party AI model providers, processed, and returned.

7.3

Every agent is AI. None is a person. Their names, personas and faces are created by us and depict no real individual. We label each agent as AI wherever you meet one.

7.4

We do not train AI models on your material. We train no model of our own on it. Our model providers process it under their own terms, and where a provider offers a setting that excludes submitted material from being used to improve its models, we switch that setting on.

7.5

We do not use your material to serve anyone else. Your Customer Material and Customer Data are used to produce your Outputs, and for nothing else, apart from the security and abuse checks in Clause 6 and aggregated or de-identified analysis that cannot be traced back to you.

7.6

A person always decides. No decision with a legal effect on you, or which otherwise significantly affects you, is made by the system alone. Routing an Instruction Brief is an administrative step. Every Output comes to you to review, and you are free to accept it, change it or discard it.

7.7

AI output can be wrong. An Output may contain errors or statements that look right and are not. Check it before you use it.

7.8

We keep your prompts, Instruction Briefs and Outputs so that you can return to your work and so that we can investigate misuse. Clause 12 gives the retention periods.

8Who we share it with

8.1

We share personal data with these classes of third party, and no others:

  1. (a)providers of cloud storage, database and website hosting;
  2. (b)providers of the AI models used to generate Outputs;
  3. (c)providers of transactional email, messaging and analytics;
  4. (d)our payment processor, Stripe;
  5. (e)the social media platforms on which a Boosted campaign is published;
  6. (f)our professional advisers, including auditors, accountants, bankers, insurers and lawyers;
  7. (g)a regulator, government agency, law enforcement agency, court or tribunal, where the law requires or allows it;
  8. (h)companies in our group, for the purposes in Clause 6; and
  9. (i)a person to whom we transfer, or propose to transfer, our business or a material part of it, together with that person’s advisers.
8.2

Each provider we engage must process personal data only on our instructions, keep it secure to the standard in Section 9 of the Act, and tell us about any breach affecting it.

8.3

Where we act as your processor, we share Customer Data only with the classes above, or as you instruct, or as the law requires.

8.4

Our payment processor is Stripe. You pay on Stripe’s own page. We send Stripe your email address, so that it can send you the receipt, and the Plan or pack of Credits you are buying, the amount and your Account reference, so that the payment is matched to your Account. Your card details are entered on Stripe’s page and go to Stripe only: we never see or store them. If you take a Plan, Stripe also keeps your subscription and the card you pay with, so that it can charge you each month until you cancel. We keep what you bought, what you paid and Stripe’s reference for the payment in your Account’s Credit records. For the payment it takes for us, Stripe acts on our instructions. For your card details, and for the checks the law requires of a payment provider, it acts on its own account, under its own privacy policy.

9Where it goes outside Malaysia

9.1

What you upload is stored in Malaysia. Some of the services that process it are not. The places are:

Website hosting
[Place of processing to be confirmed]
Database hosting
[Place of processing to be confirmed]
AI model providers
[Places of processing to be confirmed]
Transactional email
[Place of processing to be confirmed]
Payment processing
Stripe, which may process this data outside Malaysia. Where it does so will be recorded here once it is confirmed.
Social media platforms
[Places of processing to be confirmed]
9.2

We transfer personal data out of Malaysia on one or more of the bases in Section 129 of the Act: that the place has a law substantially similar to the Act, or ensures an adequate level of protection at least equivalent to it, as we assess it; that you have consented; that the transfer is necessary to perform our contract with you, or a contract with a third party made in your interest; or that we have taken all reasonable precautions and exercised all due diligence to ensure the data will not be processed there in a way that would contravene the Act.

9.3

We carry out a transfer impact assessment for each place, review it at least every three years, and sooner if the law there or the recipient’s systems change materially. Where we rely on precautions and due diligence, we put contractual clauses in place with the recipient giving protection at least equivalent to the Act.

10Data about other people that you give us

10.1

What you upload will often contain other people’s personal data. When you give it to us you confirm that:

  1. (a)you are entitled to disclose it to us and to let us process it as described here and in Schedule 1 to our Terms of Use;
  2. (b)you have given every notice and obtained every consent the Act requires of you; and
  3. (c)where it is sensitive personal data, the explicit consent required by Section 40 of the Act has been given.
10.2

Telling those individuals about this Notice, or its substance, is your responsibility.

10.3

You can limit what we process about them: remove or mask it before you upload, upload only what the Output needs, and ask us to delete it under Clause 13.

10.4

If one of them comes to us directly, we will normally pass the request to you, because you know what the material is and why it was supplied, and we will give you reasonable help in answering it.

11Sensitive personal data

Sensitive personal data has the meaning in Section 4 of the Act and includes information about physical or mental health, political opinions, religious beliefs, and the commission or alleged commission of an offence. The platform is not built to handle it and we do not ask for it, so please do not upload it. If it reaches us inside your material, Section 40 requires the explicit consent of the person concerned. We cannot obtain that consent ourselves, so we rely on your confirmation in Clause 10.1(c) that it has been given.

12How long we keep it

12.1

We do not keep personal data longer than we need it, as Section 10 of the Act requires.

Account and registration
24 months after your Account closes.
Customer Material and Customer Data
90 days after your Account closes. You can export it at any time while the Account is open, and for 30 days after the Terms end.
Prompts, Instruction Briefs and Outputs
24 months from when they were generated.
Billing and accounting
7 years from the end of the financial year, as the Income Tax Act 1967 and the Companies Act 2016 require.
Messages
24 months from the date of the message.
Enquiries and early access
12 months, unless you open an Account.
Technical logs
12 months.
Breach records
2 years from the date of the breach.
12.2

We may keep data longer where the law requires it, or where we need it to bring or defend a legal claim, and only for as long as that lasts.

13How we protect it

13.1

We take practical steps to protect personal data from loss, misuse, unauthorised or accidental access, disclosure, alteration and destruction, as Section 9 of the Act and the Personal Data Protection Standard require. Those steps include sign-in by one-time code, restricting internal access to people who need it, encrypting data in transit, keeping each customer’s material separate, and imposing security obligations on every provider we engage.

13.2

No transmission over the internet is completely secure. We take the steps above, but we cannot guarantee absolute security, and anything you send us is sent at your own risk. Keep your one-time codes to yourself, and tell us at once if you think your Account has been accessed without your authority.

14Your rights

14.1

For personal data we hold as controller, you can ask us to do the following. Write to our data protection officer at the address in Clause 2.2. We may ask for enough information to confirm who you are and to find the data.

See your data
Ask whether we hold it and for a copy in an intelligible form, on payment of the prescribed fee. We answer within 21 days. If we cannot, we tell you in writing before those 21 days run out and answer in full within a further 14 days.
Correct it
Ask us to correct data that is wrong, incomplete, misleading or out of date. Same periods.
Withdraw consent
Withdraw your consent in writing. We stop when we receive your notice. It may mean we can no longer provide the Services to you.
Stop processing
Ask us in writing to stop, or not to start, processing that is causing or likely to cause you or someone else substantial damage or distress.
Stop direct marketing
Ask us in writing to stop using your data for direct marketing.
Move your data
Ask us in writing, by electronic means, to send your data straight to another data controller. This depends on technical feasibility and format compatibility. The Act prescribes no period for this, so we do it within a reasonable time.
14.2

For Customer Data, where we are your processor, the request goes to you rather than to us, and we help you answer it under Schedule 1 to our Terms of Use.

14.3

We may refuse an access or correction request in the circumstances the Act allows. If we do, we tell you in writing, with reasons, within 21 days.

14.4

If you are unhappy with how we have handled your data, you can complain to the Personal Data Protection Commissioner. We would rather you came to our data protection officer first, so we can put it right.

15If something goes wrong

15.1

If a personal data breach happens which causes or is likely to cause significant harm, we notify the Personal Data Protection Commissioner as soon as we can, and in any event within 72 hours of the breach, in the form the Commissioner requires.

15.2

If the breach causes or is likely to cause significant harm to you, we tell you without unnecessary delay and within 7 days of notifying the Commissioner. We will explain what happened, what it may mean, what we have done, what you can do, and how to reach our data protection officer.

15.3

If a breach affects Customer Data you control, we tell you without undue delay and give you what you need to meet your own duties under Section 12B of the Act. Notifying the Commissioner and the individuals is then yours to do.

15.4

Every provider we engage must tell us about a breach affecting data it processes for us, and help us deal with it.

16Changes to this notice

We may revise this Notice. The current version is always at www.oeru.com, and the date it was last revised is at the end. If a revision materially changes what we use your data for, or who we share it with, we will tell you before it takes effect, by email to your registered address.
